Lawyer Seth Bloom, 5th District representative on the Orleans Parish School Board, has been disciplined by the state Supreme Court's Office of Disciplinary Counsel for mishandling a client's money. The office found his actions were due to negligence and inexperience, not dishonesty. The decision was released on Nov. 16.
A former client filed the complaint, saying there wasn't enough money in the trust account Bloom held for her settlement in a court case. According to a formal agreement in which he admitted wrongdoing, Bloom attributed the error to confusion over checks from other clients. He said he replaced the money when he realized it was missing.
Bloom was given an inactive, fully deferred suspension of a year and a day plus two years of probation. He has agreed to get further financial education.
"Any suspension, even if it's deferred, is a fairly severe sanction," said Dane Ciolino, a professor at the Loyola College of Law, adding that the Louisiana Bar Association takes seriously any actions that affect clients' money.
The Louisiana Bar has five levels of discipline, Ciolino said: private admonishment, public reprimand, suspension, disbarment and permanent disbarment.
Bloom,?who was elected to the School Board in 2008,?said, "This was an unfortunate incident related to one of the first cases I ever handled as an attorney in 2004. I appreciate the outcome of the process and look forward to the future."
